Federal Intervention and Consent Decrees Imposed
The Department of Justice has been intervening to force settlements and Consent Decrees since 2015.
The Upshot:
Federal law allows fines up to $75K for the 1st violation and $150K for additional violations.
The remedy for most individual or class-action lawsuits: the corporation must remediate its digital properties to conform to current WCAG standards and adhere to court-ordered monitoring for several years. The corporation must bear the costs of compliance and typically pay the plaintiff’s legal fees. These judgments have been affirmed by the US Supreme Court.
Intangible costs: adverse publicity and damage to the corporate brand.
